Terms and Conditions of Use
A. General
  1. The website TravelBook.ph (the "Site"), including all content and infrastructure of the Site, is owned and operated by Travel Book Philippines, Inc. (the "Company") and is provided for your (the "User" or "you") personal non-commercial use only, subject to the terms and conditions set out below.
  2. These Terms and Conditions of Use (the "Terms and Conditions" or "T&Cs"), as may be amended from time to time, shall apply to all acts engaged in by the User who makes use of the hotel reservation service provided by the Company that is made available online on the Site through any computer and mobile device, or through the call center (the "Call Center") through any telephone or mobile device, hereunder collectively referred to as the "Service."
  3. The Site provides an online platform through which hotels, including all types of temporary accommodation, can advertise their rooms for reservation, and through which visitors to the Site can place reservations and payments for these rooms. By making a reservation through the Site, you enter into a direct, legally binding contractual relationship with the hotel where you book. In this transaction, the Company acts solely as an intermediary between you and the hotel, transmitting the details of your reservation to the relevant hotel and our affiliate service provider, then sending you a confirmation email for and on behalf of the hotel.
  4. Other documents, including but not limited to the Privacy Policy, Warnings, and the like, shall constitute part of these Terms and Conditions. When you use the Service you declare that you agree to follow these Terms and Conditions. If you do not agree to these Terms of Use, you shall cease use of the site immediately.
B. Our Services
  1. The Service offered by the Company enables you to reserve rooms at hotels, resorts, villas, inns, and other types of temporary accommodation previously registered and displayed on the Site as posted facilities ("Posted Facility"). The reservation for the rooms at the Posted Facility is made directly by yourself through the internet via the Site or through agents of the Call Center. The Posted Facilities provide reservations to their accommodation ("Accommodation Services") voluntarily and meet their obligations to users of the Site as their own responsibility.
  2. The Service allows you to search for available rooms or Accommodation Services for specific dates at various Posted Facilities and display the search results by certain criteria such as location. Details of these Accommodation Services and other related information (e.g. child policy, extra person charge, etc.) are available on the Site through the Posted Facilities' listings. These listings and their contents are maintained by the Posted Facilities. The Company is not responsible for the completeness or accuracy of these listings or the Posted Facilities' appearance in relevant search results. The presence of these listings on the Site or in the search results does not constitute an endorsement or recommendation of the said Posted Facilities.
  3. You complete a reservation for a Posted Facility's accommodations by specifying a room and inclusive stay dates and paying the final required fee, based on the payment option the Posted Facilities accept. When you complete a reservation through the Site or Call Center, an agreement regarding the use of the relevant Accommodation Services is created between you and the Posted Facility (the "Usage Agreement") which shall take effect when a reservation number is issued by the Site or the Call Center. A reservation is considered complete and a Usage Agreement in effect if a booking number is issued, through any or all of the following methods: displayed online through the Site, delivered through a reservation confirmation e-mail, or provided verbally by a customer service representative through the Call Center. When making a reservation, you shall ensure that you receive the reservation number and make every effort to avoid and address circumstances that may prevent you from doing so, such as system or computer failure, errors in entering the e-mail address, or delivery failure or interception, such as when the reservation confirmation e-mail is interpreted by your e-mail service as spam. The Company will make all reasonable efforts to transmit the reservation number accurately, but does not make any warranties covering failures to correctly obtain the reservation number, such as in cases of non-receipt of e-mail, incorrect recording of the reservation number, and similar circumstances.
  4. When you enter into a Usage Agreement, you are deemed to have agreed to assume all obligations of the Usage Agreement, including making payment and bearing any cancellation charges as stated in the Site by the Posted Facility. You are responsible for retrieving the reservation number, which will be required by the Posted Facility before they provide the Accommodation Services. The Posted Facility will require you to present the voucher number or reservation confirmation e-mail and your identification, and reserves the right to withdraw provision of the Accommodation Services if you do not comply with these requirements.
  5. The Company reserves the right to refuse provision of the Service or block Users from the Site for whatever reasons it deems valid. These reasons may include, but are not limited to, identification of User for known or suspected fraud or other illegal activities, blacklisting by Posted Facilities or credit card facilities, or repeated violation of these Terms and Conditions.
C. Price Rates
  1. In using the Site, you understand and acknowledge that information relating to the availability or price of rooms ("Price Rates") provided by the Posted Facility may be different from the information provided in other websites or other media. The Price Rates presented on the listings of the Posted Facilities shall exclude service charges, value added tax, and other taxes and fees. The final required fee for the relevant Accommodation Services, including applicable charges, taxes, and fees, shall be displayed during the booking process before you make your payment.
  2. You also understand and acknowledge that Price Rates presented by the Posted Facility are subject to change without prior notice. Price Rates after any such changes shall only apply to Users who enter into a Usage Agreement after the changes take effect, and Price Rates before such change shall apply to Users who entered into a Usage Agreement before the changes take effect.
  3. From time to time, special Price Rates may be displayed on the Site or be made available through the Call Center. Accommodation Services provided at these special Price Rates may be subject to certain conditions, such as no cancellations or limited inclusive stay dates. By availing of these special Price Rates, you agree to comply with any applicable conditions.
  4. Price Rates are for room charges only, for the number of persons and inclusive stay dates indicated. Extra beds for additional persons will incur additional charges, and the Posted Facility has the right to refuse to accommodate more than the number of persons indicated in the Usage Agreement. Certain Posted Facilities may also charge additional fees for optional services once you are at the hotel. These are outside the scope of the Usage Agreement and shall be settled between you and the Posted Facility directly.
D. Cancellations
  1. By entering into a Usage Agreement, you accept and agree to the applicable cancellation and no-show policies of the relevant Posted Facility. The cancellation and no-show policies of the Posted Facilities are available in their respective listings and are noted during the booking procedure and in the reservation confirmation e-mail. You agree to pay any cancellation charges specified in these policies. Regardless of the Posted Facility's cancellation and no-show policies, the Company may charge a cancellation processing fee, which will be specified in the cancellation procedure. As noted in Section C.3. above, certain Price Rates or special offers are not eligible for cancellation. Please check the room plan details thoroughly for any such conditions prior to making your reservation.
  2. To review your reservation, please refer to the reservation confirmation e-mail and follow the instructions therein, or if you are a member, log in and access your booking records through the Site. If you are a member, you can initiate cancellations by logging in and using the Site functions. If you made the reservation through the Call Center, or if you made an online reservation without logging in, you should cancel your reservation by contacting the Call Center and providing the relevant reservation number. Follow the specified cancellation procedures provided in each case.
  3. In circumstances where you do not have the relevant reservation number, such as if you do not have access to or lose the reservation confirmation e-mail, contact the Call Center and provide the requested information. Follow the specified cancellation procedure as outlined by the Call Center representative or as transmitted via e-mail. If the relevant Posted Facility suffers any damage as a result of your failing to take such steps or failing to follow the specified procedure, you shall be responsible for any such damage.
  4. In some cases, you may be due refunds after the cancellation is completed. If the reservation payment was made online using a credit card, the refund will be processed as a chargeback, less any processing fees required by your credit card company. If the reservation payment was made offline through bank deposit, the Company will contact you to specify the refund procedure.
  5. For cancellations initiated by you, cancellation shall take effect once a cancellation reference number is issued. The cancellation reference number may be issued through any or all of the following methods: displayed online through the Site, delivered through a cancellation confirmation e-mail, or provided verbally by a customer service representative through the Call Center. The Company will make all reasonable efforts to transmit the cancellation reference number accurately, but does not make any warranties covering failures to correctly obtain the cancellation reference number, such as in cases of non-receipt of e-mail, incorrect recording of the cancellation reference number, and similar circumstances.
  6. If you fail to appear on the scheduled inclusive stay dates of the Accommodation Services without any prior notice, and as a result fail to use the relevant Posted Facility, the Company and the Posted Facility shall deem such failure as cancellation without notice, or no-show, according to the relevant no-show policies. You agree that you will be forfeiting a portion of or the full amount of your fee according to the relevant policies. The Company and the Posted Facility may also take necessary measures (including legal measures), such as the suspension of the use of all the services relating to the Site and the Service or cancellation of membership.
  7. The Company and the Posted Facility reserve the right to cancel specific reservations for whatever reason it deems appropriate, without the need to justify the cancellation. In such cases, you will be notified and advised of the specified procedure to follow.
  8. Cancellations must be coursed through the Company. Cancellations made through the Posted Facility are not allowed and will not be considered valid.
E. Credit Card Use
  1. The Company uses a three party system to process credit card transactions and does not collect or store any credit card information provided.
  2. If you use a credit card for your payment, you represent that the card is your own and you commit to make the necessary payments as required by your bank or credit card provider. You take full responsibility for the transactions made using your credit card.
  3. The Company makes all reasonable efforts to prevent and investigate credit card fraud and unauthorized or illegal use of reservation numbers. These measures include requiring Posted Facilities to check the User's identification upon check-in to verify their names against the credit card used for payment. However, the Company makes no warranties relating to the effectiveness of this procedure to prevent fraud and shall not be held liable for any cases of credit card misuse or fraud.
  4. You are responsible for immediately reporting suspected credit card fraud to your bank or credit card provider and the Company. In such an event, you shall provide formal documentation or proof of fraud.
  5. In the event of credit card fraud or disputes, if fraud is proven and the required documentation provided, the Company will refund the full amount of the Usage Agreement as stated in the reservation confirmation e-mail if the Usage Agreement is unconsummated and the Accommodation Service has not yet been provided. However, if the Accommodation Service has already been provided by the Posted Facility, the Company will not make any refunds.
  6. Should you fail to receive a Booking Confirmation Email after attempting to book with a credit card, the booking shall be treated as a Missing Booking (that is, the booking has not been confirmed by the Company). In the event that the Posted Facility won't be able to accommodate your booking reservation because of this, the Company is willing to help you process a refund or find an alternative hotel. You can choose to either cancel the booking or be transferred to another hotel. However, the Company shall not be responsible for any price difference incurred for transfers.
  7. In the event of unsuccessful payment transactions, the Company will contact you through the call center for the reprocessing of your payment.
F. Offline Payment Use
  1. The Company will issue payment instructions delivered through e-mail. Please take note that the room availability condition of the Posted Facility may change without prior notice even during the payment process. In the event that the Posted Facility is no longer available after the payment is confirmed (that is, the payment has been verified by DragonPay or any of our offline payment gateway partners), the above booking can be cancelled or amended. The Company is willing to help you process a refund or find an alternative hotel. However, the Company shall not be responsible for any price difference incurred.
G. Pay at Hotel
  1. Payment or deposit in advance shall not be required however, credit card information of Guests will be collected by the Company upon booking but not stored as they will be forwarded to the Posted Facility for verification purposes. The Posted Facility may decline the booking or request for a new card information should the submitted card details found to be fraud or invalid.
  2. Members have an option not to provide their credit card information but full amount will also be collected by the Posted Facility upon check-in. Non-members must present the same credit card together with proof of identification. Otherwise, the Posted Facility may require payment thru a different card or cash.
  3. In case of no show and cancellation, payment of any cancellation charges shall be made directly to the Posted Facility, as stated during the booking procedure and on the reservation confirmation e-mail. Please note that the Company and the Posted Facility have the right to automatically suspend member’s use of the “Pay at Hotel with No Credit Card Guarantee” payment option for a certain period should the cancellation charges not be settled immediately. For guests who surrendered their credit card details, the Posted Facility may debit the corresponding cancellation charges once booking cancellation is confirmed.
H. Rebookings
  1. In the case of the Company accepting a rebooking, the following conditions shall be followed in the event of a price difference in the final booking amount:
    1. Should the Posted Facility's rate have gone lower during rebooking, the Company will refund the excess amount to the User.
    2. Should the Posted Facility's rate have gone higher during rebooking, the Company shall not be responsible for any price difference incurred.
I. Change of the Posted Facilities
  1. You understand and acknowledge that Posted Facilities, including their facilities and their participation status, may be changed without prior notice, at the convenience of the Company or the relevant Posted Facility.
  2. If a Usage Agreement has been established between a User and a Posted Facility at the time of termination of participation of the Posted Facility as noted in the above item, the Usage Agreement shall remain in force and the changes made to the Posted Facility shall not affect the Usage Agreement.
  3. In case of closure or termination of operations of the Posted Facility, the Company will make a reasonable effort to assist any Users with unfulfilled Usage Agreements obtain a refund from the Posted Facility. However, the Company cannot be held liable for fulfilling the Posted Facility's obligations or refunding payments already remitted to the Posted Facility on behalf of the User.
J. Temporary Discontinuance of the Service
The Company reserves the right to temporarily discontinue operation of the Site or the Service without any prior notice in the following cases:
  1. The Site is undergoing maintenance operations or technical upgrades;
  2. The occurrence, or likeliness of occurrence of, an act of God or other state of emergency which makes operation of the Site or the Services impossible;
  3. Any other reason as determined by the Company.
K. User Obligations
  1. The Site and the Service are for your own private use. You agree not to reproduce or transmit any information obtained therein or otherwise allow such information to be used by a third party in any way, for any purpose other than for your own private use, unless you obtain prior approval of the Company and the relevant Posted Facility to do otherwise.
  2. When you undertake a Usage Agreement with a Posted Facility, you agree to comply with any terms and conditions, rules, and other requirements separately determined by the Posted Facility.
  3. In case of disclaimers or notices posted on the Site, you agree that following what is stated on the Site is your responsibility. In particular, User shall be responsible for inquiring with TravelBook.ph regarding any information relating to child policy before confirming a booking. The Company and its affiliates may not be held liable for any expenses incurred for not following said disclaimers or notices.
  4. By using the Services, you agree not to:
    1. Use the Services other than in a manner approved by the Company;
    2. Transmit or enter any information pretending to be a third party;
    3. Transmit or try to upload any harmful computer program, such as a virus or other malware, or transmit any unsolicited e-mail or spam, to the Site or any of its Posted Facilities;
    4. Transmit or try to upload any information, documents, diagrams, which includes any content against public order and morals;
    5. Commit any act that infringes or is likely to infringe any copyright or other intellectual property right of the Company, its Posted Facilities, or any third party;
    6. Slander, libel, or defame the Company, any Posted Facilities, or any third party;
    7. Register, whether intentionally or unintentionally, any false or defective information regarding the name, address, telephone number, e-mail address, or other details of any person who uses the Site or enters into a Usage Agreement with any of the Posted Facilities;
    8. Request for a transfer of transactions and/or TravelBook Reward points from one account to another no matter what the purpose, but especially for the purpose of combining Reward points and using them to book in a single account;
    9. Commit any act of disturbance or violence against any Posted Facility, the Company, or any third party;
    10. Make any reservation in a way that is inconsistent with your ability to use the Accommodation Services, such as reserving multiple Posted Facilities for the same date(s);
    11. Make any reservation with an intent to resell the reservation to any other person or for commercial purposes;
    12. Commit any other act which is in breach of, or likely to be in breach, of any applicable law or regulation.
  5. By using the Services, you acknowledge and agree that the Company will be able to provide you BIR Accredited Acknowledgement receipts for any/all booking reservations made.
  6. If any damage is incurred by the Company or any third party as a result of your actions which are categorized as any of the acts listed in the preceding paragraph, you shall assume full legal liability and shall hold the Company or such party harmless for such damage.
  7. If you have any complaints regarding the delivery of the Accommodation Services, you agree to make such complaints to the relevant Posted Facility immediately on the premises. You agree that the Company is not responsible for the delivery or quality of the Accommodation Services, which are the sole responsibility of the relevant Posted Facility.
  8. You represent that you are of legal age. If you are a minor, you represent that any reservations you make are subject to the consent of your legal guardian. If you misrepresent your age and any applicable consent, any of your subsequent actions may be rescinded.
  9. If you breach any of the above user responsibilities as set forth in the preceding items, or the Company otherwise determines any of your actions to be incompatible with the operation of the Service, the Company reserves the right to cause you to cease such act, and cancel the Usage Agreement between you and the relevant Posted Facility, and may take necessary measures (including legal measures) against you, such as suspension of the use of all the services relating to the Site and the Service, cancellation of membership, or demand for payment of damages.
L. Reviews
  1. A "Review" refers to any form of content (such as but not limited to hotel reviews and comments) submitted to TravelBook via TravelBook's Hotel Review Facility.
  2. By submitting a Review to this Site, you understand and agree to all Terms and Conditions as stated below.
  3. You grant TravelBook full, perpetual, irrevocable, free, and transferable rights to all user submitted Reviews including your name as stated in your submission.
  4. Any Review submitted to TravelBook is considered non-confidential and non-proprietary. TravelBook reserves the right to use the Review as it deems appropriate including but not limited to reproducing, editing, modifying, publishing, rejecting, or deleting the Review at its sole discretion without prior notice to User. You also grant TravelBook the right to distribute or share the Review with hotel partners.
  5. TravelBook is not obligated to publish your Review and reserves the right to decide whether or not to publish your Review at its sole and absolute discretion. We are also not obligated to allow you to modify or delete the Review after it has been submitted to TravelBook.
  6. TravelBook shall not immediately release Reviews upon submission. Reviews for a hotel property shall only be displayed on the Site after (i) approval by TravelBook Management and (2) the number of approved reviews for the property reaches five (5). Should the required amount of reviews not be reached, Guest's review will not be displayed on the Site.
  7. TravelBook is not liable and assumes no responsibility for any Review you submit. By submitting a Review to this site, you agree that you are solely responsible for the Review you submit. You must abide by TravelBook's Review Guidelines, and you must not post a Review that violates TravelBook's Terms and Conditions. You shall be held solely liable for any damages and other harmful consequences that result from violating these guidelines and restrictions.
  8. TravelBook's Review Guidelines are stated as follows. All Reviews submitted must be:
    1. Family-friendly – No objectionable content such as but not limited to profanity, threats, obscenity, vulgarity, racial slurs, hate speech, prejudiced comments, derogatory statements, libelous statements, and personal insults.
    2. Relevant – All content must be related to your stay at the hotel. No irrelevant content such as personal insults, name calling, personal political and religious views, and any general commentary unrelated and unhelpful to Guests and their decision to stay at a hotel. Smear campaigns or any Reviews that specifically aim to damage the reputation of an individual or brand (such as a Guest, TravelBook, or TravelBook hotel partner) are not allowed. Derogatory comments about other Reviews, Guests, TravelBook, or TravelBook hotel partners are also not allowed. Any questions addressed to TravelBook staff or TravelBook hotel partners should be coursed through Customer Service and should not be included in a Review.
    3. Impartial – Reviews must be truthful and unbiased regardless of whether content is positive or negative. No posting of content about aspects of the hotel or its services that you have not personally experienced. No reviews written by individuals affiliated or working for a TravelBook hotel partner will be entertained for their own hotel or their hotel competitors.
    4. Original – No using secondhand information or quoting of content from other persons, websites, Reviews, and other related providers of content. Review provided must not be submitted or published anywhere else aside from TravelBook.
    5. Non-commercial – No promotions allowed. No promoting of personal Websites or other Websites. No public posting of email addresses, phone numbers, or any other personal information.
    6. Lawful – No content that violates any law including but not limited to the rights to privacy and publicity, the Cybercrime Prevention Act of 2012, and copyright and trademark laws is allowed.
    7. Following standard email etiquette – No excessive use of all caps, slang, and symbols allowed. No HTML tags allowed.
  9. TravelBook may offer incentives in the form of TravelBook Reward points for Guests and TravelBook members whose reviews are approved and published on the Site during certain periods. TravelBook reserves the right to add, modify, or remove incentives without prior notice.
  10. TravelBook reserves the right to pursue at law any person or entity that violates your or TravelBook's rights in the Review by a breach of these Terms and Conditions.
  11. It is understood that notwithstanding the acceptance and publication of your Review, TravelBook does not in any way guarantee the truthfulness and veracity of the contents thereof. Upon publication of your Review, you agree to take full responsibility of whatever legal consequences that may arise therefrom, including but not limited to any claim for damages and intellectual property rights violation.
  12. The publication of your Review by TravelBook does not create any property right in your favor which may be enforced against TravelBook.
  13. TravelBook shall have the sole discretion and prerogative to withdraw your published Review for whatever cause at any time it may deem necessary and/or appropriate without prior notice.
M. Copyright
  1. You agree not to use any content provided in the Site or the Services, without the Company's prior approval, beyond the scope of your private use as set forth in the Copyright Act.
  2. If there is any dispute as a result of a User's breach of any provision of this Article, the User shall be responsible for resolving the dispute at the User's own expense, and shall indemnify and hold harmless the Company, its officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate or distribution partners, licensees, agents, or others involved in creating, sponsoring, promoting, or otherwise making available the Site and its contents against any liability or damages associated with such a dispute.
N. Privacy Protection
The Company abides by high ethical standards and respects your privacy. Save for disclosures required by law in any relevant jurisdiction and the disclosure of your name and email address to complete your reservation with the relevant Posted Facility, we will not disclose your personal information to third parties without your consent. However, the Company reserves the right to disclose your personal information to the Company's employees and its affiliate group of companies who have access to this information with the Company's permission and to those who need to know or have access to this information to perform the Service (including customer service and internal audit or compliance investigation) for the benefit of the User. Please read our Privacy Policy for further information.
O. Disclaimer
  1. The information displayed in the Posted Facilities' listings are provided and maintained by the Posted Facilities. You understand and acknowledge that while the Company makes every effort to ensure that any materials or Price Rates displayed on the Site are accurate as of the date of display, changes in market conditions or circumstances may occur after this date which may make information previously displayed on the Site no longer accurate or no longer reflect the current position.
  2. Notwithstanding the preceding provision, the Company hereby expressly disclaims any representation, warranty or undertaking in relation to the accuracy, completeness, quality, or adequacy of any contents of the Site.
  3. While every effort is made to list Posted Facilities which provide an acceptable standard of service and accommodation for the price paid, the Company hereby expressly disclaims any representation, warranty, or undertaking in relation to the quality or adequacy of the Accommodation Services or facilities and services of any Posted Facility listed on the Site.
P. Indemnification and Limitation of Liability
  1. The Company has no obligation to investigate the business conditions or similar conditions of any Posted Facility.
  2. The Company shall not be liable for any damages due to any loss, delay or erroneous transmission of information as a result of a natural disaster, congestion of lines, equipment failure or equipment maintenance; the termination of the Posted Facility's participation, any alteration or divulgence of information by a third party, or similar cause.
  3. The Company shall not be liable for the delivery of the Usage Agreement and Accommodation Services by the Posted Facility. If any problems, concerns, or complaints arise between you and the Posted Facility regarding the Usage Agreement or the Accommodation Services, you agree to settle the dispute with the Posted Facility and indemnify and hold harmless the Company for any losses, damages, and costs incurred during such settlement.
  4. The Company shall not be liable for any untoward incidents, such as theft, fire, flood, transport strikes, natural disasters, or similar events, that occur on the premises or in the general vicinity during your stay in the hotel.
  5. Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, the Company shall only be liable up to an aggregate amount equal to the aggregate cost of the User's reservation as set out in the reservation confirmation e-mail for direct damages actually suffered, paid or incurred by the User due to an attributable shortcoming of the Company's obligations relating to the Service (whether for one event or series of connected events).
  6. However, and to the extent permitted by law, neither the Company nor any of its officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate or distribution partners, licensees, agents, or others involved in creating, sponsoring, promoting, or otherwise making available the Site and its contents, shall be liable for any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, any inaccuracy relating to the information, including rates and availability of the Posted Facility as made available on http://www.travebook.ph the Site, the services or facilities offered by the Posted Facility, any direct, indirect, consequential, or punitive damages, losses or costs suffered, incurred or paid by the User, pursuant to, arising out of or in connection with the use, inability to use or delay of the Site, or for any personal injury, death, property damage, or other direct, indirect, special, consequential, or punitive damages, losses or costs suffered, incurred or paid by the User, whether due to legal acts, errors, breaches, gross negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or wholly or partly attributable to the Posted Facility, its employees, directors, officers, agents, representatives or affiliated companies, including any cancellation, overbooking, strike, force majeure or any other event beyond its control.
Q. Modifications to the Terms and Conditions
  1. The Company may make additions and deletions to, or otherwise modify these Terms and Conditions without any prior notice. You agree to check these Terms and Conditions each time you use the Service.
  2. If you use the Service after any modification is made to these Terms and Conditions, you shall be considered to have agreed to the modified Terms and Conditions.
R. No Assignment of Rights and Obligations
  1. You may not assign to any third party or encumber your status as a User of the Service, or any rights and obligations arising from such status, except where such assignment or encumbrance has been approved by the Company in advance.
  2. If a User breaches the preceding paragraph, the Company reserves the right to cancel the Usage Agreement between the User and the relevant Posted Facility and delete the posted information, and may take necessary measures (including legal measures) against such User, such as the suspension of the use of all the services relating to the Site and the Service, the cancellation of membership, or the demand for the payment of damages.
  3. The Company makes all reasonable efforts to prevent and investigate credit card fraud and unauthorized or illegal use of reservation numbers. These measures include requiring Posted Facilities to check the User's identification upon check-in to verify their names against the credit card used for payment. However, the Company makes no warranties relating to the effectiveness of this procedure to prevent fraud and shall not be held liable for any cases of credit card misuse or fraud.
  4. You are responsible for immediately reporting suspected credit card fraud to your bank or credit card provider and the Company. In such an event, you shall provide formal documentation or proof of fraud.
  5. In the event of credit card fraud or disputes, if fraud is proven and the required documentation provided, the Company will refund the full amount of the Usage Agreement as stated in the reservation confirmation e-mail if the Usage Agreement is unconsummated and the Accommodation Service has not yet been provided. However, if the Accommodation Service has already been provided by the Posted Facility, the Company will not make any refunds.
S. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with, the laws of Philippines, and all disputes involving this Agreement shall be exclusively resolved in Philippine Court. Any claim or dispute arising out of or in connection with this Agreement which results in a legal proceeding shall be decided exclusively by a court of competent jurisdiction located in Quezon City, Philippines.
TravelBook Rewards Program
I. Definition of Terms
  1. "Guest" means a person who makes use of TravelBook.ph for hotel booking transactions without registering as a member of the said website.
  2. "Total booking value" means the total amount due specified in the Booking Page, computed as follows: accommodation fee less discounts arising from coupon codes and/or reward points. (reward points cannot be earned from the portion of the transaction paid up through coupons codes and/or reward points)
  3. "TravelBook hotel partner" means a hotel which sells their room accommodation through the TravelBook system.
  4. "TravelBook hotel transaction" means a hotel booking transaction completed directly through the official website of TravelBook (www.travebook.ph).
  5. "TravelBook Member" means a person who signed up as a member of TravelBook.ph.
  6. "User" means a person, whether a member or not, who makes use of TravelBook.ph for hotel booking transactions.
II. Overview
  1. The TravelBook Rewards Program ("Program") is a member loyalty program that provides Users who book using the website TravelBook.ph with rewards. The Program is created, managed, and offered to members by Travel Book Philippines, Inc. ("TravelBook" or "we") The Program shall be governed by the Terms and Conditions as specified below.
  2. TravelBook reserves the right to terminate, suspend, or change the Program at any time without prior notice, in part or in whole. This includes but is not limited to changing or modifying the Program rules and conditions, point earning and redemption procedures, member point system, and rewards.
  3. Program Rewards are accumulated in the form of TravelBook Reward points, which are earned through booking on TravelBook.ph. Each point is equivalent to 1 peso and is convertible to discounts on future member bookings. Conversion equivalence is subject to change by TravelBook.ph without prior notice. Points are displayed as peso values on the site for easy understanding.
  4. To be eligible to join the Rewards Program, the User must create an account with TravelBook by signing up at its official website: www.travebook.ph. The program shall only cover TravelBook hotel transactions which were booked directly through www.travebook.ph. TravelBook hotel bookings made via Cebu Pacific Air, 2GO Travel and GetGo are expressly excluded from the Program.
III. Earning Rewards
  1. Every TravelBook hotel transaction booked via TravelBook.ph or through its hotline shall earn the User points equivalent to five percent (5%) of the total booking value involved in the subject transaction. The points earned shall be displayed below the total amount due in the Booking Page and shall remain in pending status until the transaction is paid and the check-out date of the TravelBook hotel transaction involved has lapsed. The computation of the reward value shall be subject to change without prior notice.
  2. Points are earned in integral values. That is, you cannot earn half points or any points with decimal values. In cases where 5% of your total booking value results in an amount with decimal values, points are rounded down to the nearest integral value.
  3. All TravelBook members who have made at least one (1) booking with checkout date before 03 November 2014 shall receive an initial 500 Reward points ready for use. Initial reward points will be credited on 10 November 2014. Subsequent points shall be earned through bookings with checkout date on or after 03 November 2014.
  4. Earned points shall be awarded to the TravelBook member's account through email address matching. Thus, TravelBook members must ensure that all their hotel booking transactions via TravelBook.ph were made under the e-mail address registered with TravelBook so that earned points are properly credited to their respective accounts.
  5. Members must log in to TravelBook.ph with their correct username and password in order to check their earned points. You may view your point transaction history at any time through the TravelBook Rewards control panel (http://www.travelbook.ph/myrewards). Points earned per transaction will be displayed with the label "pending" prior to your check-out date. Points will be credited as "earned" and ready for redemption after 2-3 weeks for Pay-at-Hotel bookings and at 12NN on check-out date of bookings made using other payment methods.
  6. Earned Reward points will be credited to your member account after check-out. However, you have the responsibility of making sure your Reward points have been credited properly. Any claim for Reward points not duly credited must be submitted to TravelBook within three (3) months of claimed accrual date. TravelBook reserves the right to require proof of Rewards point accrual such as, but not limited to, Booking Confirmation Email or any documentation that can prove an eligible transaction was made, which earned points.
  7. TravelBook reserves the right to add, modify, or remove any or all means of earning Reward points at any time without prior notice.
  8. TravelBook.ph will be offering limited reward points, which will expire in two months. The said points will be credited to the user's account after checking out from the booked accommodation, like normal reward points. Promo and booking period is from November 21, 2016 to January 2, 2017. All available check-in dates are applicable to this promo.
IV. Redeeming Rewards
  1. Only TravelBook members may redeem points. Thus, a Guest who has earned points through a non-member booking must sign up for a free TravelBook.ph membership in order to claim their points and redeem them. Redemption can only be made online by logging in their respective TravelBook accounts.
  2. Currently, Reward points may be redeemed as an equivalent to cash to avail of discounts on TravelBook booking transactions. TravelBook reserves the right to add, modify, or remove any or all means of redeeming Reward points at any time without prior notice.
  3. The amount of redeemable Reward points you have available will be viewable on the Booking Page when you are about to make a transaction. Reward points are displayed in peso value. To redeem points, enter your preferred peso value in the specified text box and apply points. The number of points applied will be automatically deducted from your total booking value for one transaction.
  4. You may redeem points amounting to the total amount due for your booking transaction in full. If this is the case, there will be no need for you to choose a payment method, and you will be able to receive your Booking Confirmation Email once the transaction is confirmed.
  5. In cases where the amount of the points to be redeemed is less than the total booking value, the TravelBook member may use up all of his reward points for such transaction. However, a minimum of twenty pesos (Php20.00) shall remain as balance in the total amount due for final payment.
  6. Your redeemed points are immediately deducted from your account upon completion of the booking transaction. You may find a transaction detailing your point redemption on the TravelBook Rewards control panel.
  7. TravelBook Reward points have no cash value except as used within the Program and cannot be exchanged for cash or items, traded/bartered, sold, or transferred.
  8. Points from different accounts may not be transferred or combined for redemption.
  9. If a TravelBook hotel partner inappropriately denies a member entry for a booking transaction using a point redemption, TravelBook's liability shall be limited to the actual points redeemed for such booking transaction, which shall be refunded to the member so that he may use the same for his subsequent bookings. TravelBook shall in no case be held liable for the acts and omissions of any of its TravelBook hotel partner in relation to the booked hotel transaction.
  10. TravelBook hotel partners may be added or removed from the Program at any time without prior notice. They may also allow or disallow members from using Points for booking transactions at any time without prior notice. TravelBook shall not be held liable for any changes resulting from removal or cancellation of a hotel partner from the Program.
  11. TravelBook reserves the right to audit Reward points for any member account at any time without prior notice. In cases where violations or discrepancies are discovered, any Rewards redemption requests of said member may not be granted outrightly pending the resolution of the violation or discrepancy found.
V. Expiration of Rewards
  1. Reward points earned shall be valid for a period of one (1) year from the time they were earned and properly credited to the account of the TravelBook member. Any points that remain unredeemed upon the lapse of the cited period will no longer be valid for use.
  2. Reward points will be consumed in the sequence they were earned. That is, for example, points earned earlier in the year will be consumed first when a booking transaction is made using points.
  3. TravelBook.ph will be offering limited reward points, which will expire in two months. The said points will be credited to the user's account after checking out from the booked accommodation, like normal reward points. Promo and booking period is from November 21, 2016 to January 2, 2017. All available check-in dates are applicable to this promo.
VI. Cancellation
  1. Individual hotel cancellation policies apply to bookings made using Reward points.
  2. For transactions partially paid with points, the cancellation fee shall first be deducted from the portion of the total booking value actually paid by the TravelBook member. Any cash balance which remains after cancellation fee is applied shall be returned to the TravelBook member. If the actual payment made is not sufficient to cover the cancellation fee in full, the outstanding balance thereof shall be deducted from the points redeemed for the transaction. Any remaining point balance after cancellation fee is applied to a booking transaction shall be returned to the TravelBook member and shall be available for immediate use.
  3. Returned Reward points from a cancelled transaction will maintain their original expiry date. Should points already be expired after a transaction is cancelled, they will no longer be valid.
VII. Modifications to the Terms and Conditions
  1. TravelBook reserves the right to add, remove, modify, or limit these Terms and Conditions without prior notice. We will provide notice of the changes depending on the level of modification.
  2. Should minor changes be applied, we will modify the Terms and Conditions to show the revisions and include an "Effective Date."
  3. Should material changes be applied, TravelBook shall notify you of the same via the email address registered under your TravelBook account. Said notice shall be deemed sufficient with or without acknowledgment of your receipt of the same.
  4. If you use the Program after any modification is made to the Terms and Conditions, you shall be considered to have agreed to the modified Terms and Conditions.
  5. TravelBook.ph's original Terms and Conditions and Privacy Policy still apply.
VIII. Miscellaneous Provisions
  1. Earned rewards points shall not be deemed as property of any TravelBook member. Rewards points may not be exchanged for cash, assigned, bartered, or otherwise transferred.
  2. TravelBook reserves the right to revoke earned rewards points at any time should it find valid and justifiable grounds to do so. Furthermore, TravelBook shall have the right to terminate the membership of any TravelBook member found to be using the Program in violation of the Terms and Conditions herein set forth or any law or government rule or regulation. Said termination of membership shall result to the forfeiture of all earned rewards points and such other privileges or benefit that may have been extended to the member. The foregoing shall be without prejudice to the rights and remedies available to TravelBook under law and equity.
  3. Should any question arise as to the interpretation or enforcement of any of the Terms and Conditions herein provided, TravelBook shall have the sole authority to address and resolve the same.
  4. In the event that any provision of the Terms and Conditions herein set forth is rendered void, invalid or unenforceable by operation of applicable laws or regulations, such provision or part thereof may be severed therefrom without affecting the other provisions hereof.
  5. The Terms and Conditions herein embodied shall be interpreted and construed in accordance with the laws of the Republic of the Philippines. In the event of any court action arising out of or relating to enforcement of the said Terms and Conditions or the TravelBook Membership of any member, the Member shall submit to the jurisdiction of the courts of Pasig City, to the exclusion of all other venues.
